Punjab & Haryana HC stays Reservation Act 2016

The Punjab and Haryana High Court on Thursday stayed the reservation for the Jats and five other communities provided by the Haryana government under a newly carved Backward Classes (C) category.
The High Court bench headed by Justice S S Saron passed the order while hearing a petition of Murari Lal Gupta who was seeking a direction to quash block 'C' of the Act, which provides reservation to the Jat community under a newly carved Backward Classes (C) category.

The Petition challenged the constitutional validity of The Haryana Backward Classes (reservation in services and admission in educational institutions) Act 2016 that was passed unanimously by the state Assembly on March 29.

The counsel for the petitioner stated that providing reservation on the basis of the Gupta commission report which the SC has already quashed tantamount to the revision of a judicial order, which the legislature cannot do. Notice has been issued to the Haryana govt and next hearing is on July 21.

Besides Jats there are five other communities that come under the act. They are Jat Sikhs, Muslim Jats, Bishnois, Rors and Tyagis who would be entitled to 10 per cent reservation in government services and admission in educational institutions.

It is to be noted that earlier this year itself the Jats had resorted to violent agitation for reservation and only agreed to call off the agitation when the govt promised to take appropriate steps towards their demands.
